Open Door Exchange, Inc., (“ODE,” “we,” or “our”) is committed to protecting your privacy. Our Privacy Policy (“Policy”) governs how we collect and use information about you in relation to Open Door Exchange's digital communications and text message marketing program(s) (the “Messaging Service” or "Service"), which we make available to you through a third-party service provider, Zoom.
 

By using the Service, you agree to the terms of this Policy. Open Door Exchange, Inc., reserves the right, in our sole discretion, to modify or change this Policy at any time with or without prior notice to you. The date of the last update will be posted at the top of this Policy for your convenience. This Policy, and any changes, are effective as soon as posted and supersede any prior Policies. Your continued use of the Service following the posting of any changes to the Policy constitutes your full acceptance of those changes.

Collection of Information

Through your use of the Service, we will receive Personal Information through phone or email correspondence, paper form or website inquiry. “Personal Information” is information that individually identifies you, such as your mobile phone number you provided when signing up for the Messaging Service, any comments or feedback regarding the Service that you send to us, or any other information that you choose to include in messages you send through the Service. When you send any correspondence or messages via the Service, we will also collect your messaging history and any information included in those messages.


We may also collect Personal Information about you using cookies or similar technologies. Cookies are pieces of information that are stored by your browser on the hard drive or memory of your device. Cookies enable personalization of your experience on the Service (e.g., sending you personalized text messages such as shopping cart reminders).


We will also collect your contact information if you contact us with questions about the Service.

Use of Information

We use Personal Information to (a) provide you with the Service, (b) process and respond to inquiries, (c) improve the Service, (d) if necessary, contact you with important announcements or messages, (e) conduct research, and (f) provide anonymous reporting for internal and external clients and partners.


Each message that you send through the Service (either to us or to other users of the Service) is stored on our servers. We retain these messages on our servers. Open Door Exchange, Inc., utilizes servers and services owned by third parties.

Sharing of Information

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We may use or disclose Personal Information in any of the following limited circumstances:

  • We have your consent.

  • We need to enforce our Terms of Service.

  • We provide such information to trusted businesses or persons for the sole purpose of processing Personal Information on our behalf or providing the Service to you. When this is done, it is subject to agreements that oblige those parties to process such information only on our instructions and in compliance with this Policy and appropriate confidentiality and security measures. If the third party fails to comply with our terms, ODE is not accountable in any way for any liability or reimbursement.

  • We provide Personal Information to a company controlled by, or under common control with, ODE for any purpose permitted by this Policy.

  • We transfer Personal Information about you if ODE is, or its assets are, acquired by or merged with another company.

  • We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights, or the legal rights of others, or defend against legal claims.

  • We believe it is necessary to share Personal Information to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Open Door Exchange's Terms of Service, or as otherwise required by law.

  • We believe disclosure of Personal Information is necessary or appropriate to: (i) comply with applicable law and legal processes; (ii) respond to requests from public and government authorities, including public and government authorities outside your country of residence; (iii) enforce a contract with us; (iv) protect our rights, privacy, safety, or property, and/or that of our affiliates, you or others; and (v) allow us to pursue available remedies or limit the damages that we may sustain.


We may share aggregated information with others without further notice. An example of this would be the number of people who used the Service in a given month or the total number of texts sent in a given week.

Protection of Information

Open Door Exchange, Inc., takes a variety of physical, technical, administrative, and organizational security measures based on the sensitivity of the information we collect to protect your Personal Information against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access. Unfortunately, no online activity can be guaranteed to be 100% secure. You should note that in using the Service, your information will travel through third-party infrastructures which are not under our control (such as a third-party provider’s SMS delivery platform or your carrier network). While we strive to protect your information against unauthorized use or disclosure, we cannot ensure or warrant the security of any information you provide. By using the Service, you agree that ODE is not liable for any unintentional disclosure.

Retention of Information

We retain your Personal Information for as long as you participate in the Service or as needed to comply with applicable legal obligations. We will also retain and use your Personal Information as necessary to resolve disputes, protect us, our clients, staff, and volunteers, and enforce our agreements.

Intended Audience

The Service is not intended for minors, and Open Door Exchange, Inc., does not knowingly collect information from children or minors.


Minors aged 17 or younger should not submit any Personal Information without the permission of their parents or guardians. By using the Service, you are representing that you are at least 18, or that you are 17 or younger with your parents’ permission to use the service.


ODE requires that users of the Service be limited to US residents only.

Opting In

A mobile user might opt-in by:
 

  • Entering a phone number online,

  • Sending an Mobile Originating (MO) message containing an advertising keyword, or

  • Filling out a paper form that includes their phone number

Opting Out

ODE's third-party service provider gives you the ability to opt out of the Service for any reason. You can opt out by texting “STOP”.


We reserve the right to send you certain communications relating to the Service, such as announcements and administrative messages, without offering you the opportunity to opt-out of receiving them.
